Case Assessment:
Our clients’ daughter, son-in-law, and grandchildren were all British citizens with exemplary records, both in terms of immigration and criminality. Their son-in-law, a successful businessman, supplied vital drugs to the NHS and possessed impeccable credentials registered with the Medicines Healthcare Regulatory Authority. He also demonstrated the ability to cover all travel and accommodation costs, supported by comprehensive evidence of his business and personal finances. Additionally, our clients owned properties, land, and other commercial assets, lived with their son and grandchildren in Pakistan, and received two pensions.
Resolution:
Despite the initial visa refusal with no right of appeal, we advised our clients on available options: reapplication, appealing the decision, or pursuing a judicial review. Opting for a judicial review, we served a pre-action letter to the Secretary of State for the Home Department, highlighting the irrationality and non-compliance with the law. Within 14 days, the SSHD responded, reversing the refusals and sending them back to the Entry Clearance Officer for reconsideration.
Successful Outcome:
With the case re-evaluated, the Entry Clearance Officer made the correct decision and granted our clients the visit visas they sought. Our diligent efforts, knowledge of immigration law, and strategic approach resulted in a positive resolution for our clients, enabling them to visit their daughter and grandchildren as planned.
