Deportion

Deportation is a process whereby the Home Office authorises people out of the UK when they have no legal right to remain in the country. People can be deported if is judged to be beneficial for the public good. This includes people who:

  • enter, or attempt to enter, the UK illegally (including people entering irregularly and by means of deception on entry)
  • are subject to deportation action; for example, due to a serious criminal conviction
  • overstay their period of legal right to remain in the UK
  • breach their conditions of leave
  • have been refused asylum

Deportation affects non-British citizens and those with criminal convictions or ‘bad characters’. If you are an over-stayer or have breached your visa conditions, you will normally be removed through a process called administrative removal.

A deportation order has three effects:

  1. It requires the person to leave the UK and enables the enforced physical removal of that person;
  2. It prevents the person from returning lawfully to the UK while the order remains in force;
  3. It invalidates any leave the person had.

A deportation order involves a potentially permanent ban on re-entry (although a deportation order can be cancelled, formally referred to as “revocation”). It can be enforced where a person possesses leave to enter or remain, and/or there is a specific criminal offence of breach of a deportation order.
